Terms of Use
Effective October 12, 2026
These terms are an agreement between you and the operator of DwellSignal ("DwellSignal," "we," "us"). They cover the website, the app, the API, the MCP server, reports and email (together, the "Service"). By using the Service you agree to them. If you do not agree, do not use it. Section 15 requires disputes to be settled by individual arbitration and waives class actions; read it.
1. What DwellSignal is, and is not
DwellSignal publishes general real-estate research: estimates of rents, nightly rates, occupancy, revenue, home values, costs, returns and risk, and records drawn from public sources such as permit registries. The same information is available to everyone, and it is not tailored to your finances, goals or circumstances.
Nothing in the Service is financial, investment, tax, legal, accounting, insurance, lending or real-estate brokerage advice, and none of it is an offer, solicitation or recommendation to buy, sell, finance, rent or hold any property. DwellSignal is not a registered investment adviser, broker-dealer, real-estate broker or agent, appraiser, mortgage lender or broker, insurance agent, tax preparer or law firm, and using the Service does not create an advisory, fiduciary, agency or attorney-client relationship.
Labels such as "Buy," "Caution," "Avoid," scores, grades and verdicts are the output of a published method applied to the inputs on screen. They are research signals, not recommendations to you. Our value and revenue estimates are not appraisals and must not be used in place of an appraisal, inspection, survey or title search, or to support a lending decision.
2. Estimates, projections and data
- Estimates are uncertain. Most figures are statistical estimates with error, which we state where we can. Ranges and intervals describe model uncertainty and are not guarantees that a result will fall inside them.
- Projections are not predictions. Projected income, appreciation, cash flow, returns, break-even points and scenarios depend on assumptions, many of them yours, and on conditions that change. Actual results will differ, possibly by a lot. Past market performance does not predict future results.
- Data can be wrong, late or incomplete. We build on public and third-party sources we do not control, including government agencies, Zillow, Redfin, Inside Airbnb and public listing data. Those sources contain errors, and our processing can add more. A dash or "not measured" means we have no figure; it never means zero.
- Specific properties differ. Figures for a place describe that area, not any one home. Condition, size, location, management, financing, taxes, insurance, HOA rules and many other factors change the result.
3. Rules, permits and legality
Short-term-rental and rental rules, permits and taxes vary by city, county, state and homeowners' association, and they change often. A permit match, licensed share, "legal" or "unpermitted" label, or rules summary describes what public records and our matching show. It does not establish whether any property may lawfully be rented, and it may be out of date. Some summaries are extracted by software from ordinances and can be wrong. Before you buy or rent out a property, confirm the rules with the local government, your HOA, your lender and your insurer, and with a lawyer if needed.
4. AI-generated content
Some features, such as the Deal Desk analyst, chat and market briefs, use AI language models to write text. AI output can be inaccurate, incomplete or out of date, and it can state wrong things confidently. Treat it as a draft for your own checking, never as advice.
5. Your responsibility
You alone decide whether and how to use the Service, and you are responsible for your decisions. Do your own due diligence and consult licensed professionals (an attorney, accountant, financial adviser, inspector, appraiser, insurance agent or real-estate professional) before acting. Real-estate investing carries risk, including the loss of your money and more than your down payment.
6. Fair housing and lawful use of property data
You may not use the Service to discriminate in housing on the basis of race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin or any other status protected by law, or otherwise in violation of the federal Fair Housing Act or similar state and local laws. Some records include information about hosts, owners or permit holders. You may not use it to harass, stalk or intimidate anyone, or to contact people in violation of law, including telemarketing and anti-spam laws.
7. Accounts
You must be at least 18 and able to form a binding contract. Give accurate information, keep your sign-in secure and tell us about any unauthorized use. You are responsible for activity under your account.
8. Acceptable use
You agree not to:
- scrape, crawl, bulk-download or systematically copy the Service, except through the API or MCP server within their published limits;
- resell, sublicense or redistribute our data, or use it to build or train a competing dataset, product or model;
- get around rate limits, access controls or security, or probe, scan or test the Service's vulnerabilities without our written permission;
- reverse-engineer the Service, except where the law allows it despite this restriction;
- interfere with the Service, overload it, or introduce malware;
- misrepresent our figures, present them as your own appraisal or guarantee, or remove source labels or attributions;
- use the Service for anything unlawful or for anyone else's unlawful purpose.
9. API, MCP server and AI assistants
We offer the API and MCP server so that developers and AI assistants can read our data. We may change, limit or end them, or require keys, at any time. If you publish figures from them, credit "DwellSignal" and keep the source labels and as-of dates. When an AI assistant such as ChatGPT or Claude uses our MCP server, the assistant writes the answer you see: we supply data, and we are not responsible for how a third-party assistant interprets, summarizes or presents it. That assistant's own terms apply to your use of it.
10. Content and intellectual property
The Service, including its software, design, text, methods, compilations and derived data, belongs to us or our licensors and is protected by law. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use it under these terms. Third-party data stays the property of its owners and may carry its own terms. Public-domain government data stays public.
You keep ownership of what you enter, such as deals, notes and client details. You give us permission to store and process it to run the Service for you. If you send us feedback or suggestions, we may use them freely and owe you nothing.
To report content you believe infringes your copyright, email hello@dwellsignal.com with the work, the location on our site, your contact details, and a statement that you have a good-faith belief the use is unauthorized and that your notice is accurate.
11. Paid plans
Paid plans and reports may be offered. If you buy one, the price, billing period and features are shown at checkout, and Stripe processes the payment. Subscriptions renew automatically until you cancel. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Except where the law requires otherwise, payments are not refundable, including for partial periods or unused reports. We will tell you before a price change applies to your plan. You are responsible for any taxes.
12. Third-party services and links
The Service links to and relies on third-party sites and services, such as maps, sign-in, email and payments. We do not control them and are not responsible for their content, availability or practices.
13. Disclaimer of warranties
THE SERVICE AND ALL DATA, ESTIMATES, REPORTS AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS AND TIMELINESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY RESULT, RETURN OR OUTCOME WILL BE ACHIEVED. Some jurisdictions do not allow certain warranty disclaimers, so some of these may not apply to you.
14. Limitation of liability and indemnity
TO THE FULLEST EXTENT THE LAW ALLOWS, DWELLSIGNAL AND ITS OPERATOR, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, INVESTMENT VALUE, PROPERTY VALUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY DECISION YOU MAKE USING IT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US $100. These limits apply whatever the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited by law.
You agree to defend, indemnify and hold harmless DwellSignal and its operator, contractors and licensors from claims, losses and costs (including reasonable legal fees) arising from your use of the Service, your content, your property or investment decisions, or your breach of these terms or of law.
15. Disputes: arbitration and class-action waiver
Talk to us first. Before filing a claim, email hello@dwellsignal.com with a description of the dispute and the relief you want. We will try in good faith to resolve it within 60 days.
Arbitration. If it is not resolved, you and we agree that any dispute arising from or related to these terms or the Service will be resolved by final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. The Federal Arbitration Act governs this section. The arbitration will take place in the county where you live or by video, unless we agree otherwise. Payment of fees follows the AAA's rules. Either party may instead bring an individual claim in small-claims court, and either party may ask a court to stop infringement or misuse of intellectual property.
No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not combine claims or award relief to anyone other than the individual party. If this waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration, and the rest of this section still applies.
Opting out. You can opt out of this section by emailing hello@dwellsignal.com within 30 days of first accepting these terms, with your name, your account email and a statement that you opt out of arbitration.
16. Governing law
California law governs these terms, without regard to its conflict-of-laws rules, except where the Federal Arbitration Act or other federal law applies. Subject to Section 15, the state and federal courts in California have exclusive jurisdiction, and you and we consent to them.
17. Suspension and termination
You may stop using the Service at any time and ask us to delete your account. We may suspend or end your access, or change or discontinue any part of the Service, at any time, including for a breach of these terms. Sections 1–6, 10 and 13–19 continue to apply after termination.
18. Changes to these terms
We may update these terms. When we do, we change the effective date at the top. If a change is material, we will give reasonable notice, by email to account holders or in the Service, before it takes effect. If you keep using the Service after a change takes effect, you accept the new terms.
19. General
These terms and the Privacy policy are the whole agreement between you and us about the Service. If a provision is unenforceable, the rest remain in effect. Not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a reorganization, merger or sale. We are not liable for delays or failures caused by events beyond our reasonable control. You agree that we may communicate with you electronically, and that electronic notices satisfy any requirement that they be in writing.
